The futureimagebank.com End User License Agreement (EULA)

This agreement is between Future Image Ltd (futureimagebank.com) and the subscriber who establishes a username and password for the right to access, aquire, and use images from this website (You, Your or end-user).

General

By receiving a username and password you are granted a one (1) person seat license. Only one person may access the subscription web site or use images for comp use, as applicable. Multi user licenses will be delivered with the appropriate amount of usernames and passwords. This contract is personal, and You are not entitled to transfer Your user IDs or rights under this contract to a third party.

By registering with futureimagebank.com You acknowledge that You have read, understood and accepted the Terms and Conditions of this agreement. futureimagebank.com reserves the right to change this contract at any time, provided that the changes are announced on futureimagebank.com or the information is sent to the user as e-mail.

When You register with futureimagebank.com You are automatically signed up for the mailing list as well. Your personal information, like e-mail address, will not be yielded or used outside this service. You can remove yourself from the mailing list in the "My details" menu.

Copyright

The copyright and all other rights of the images is held by futureimagebank.com. By this contract, the end-user is granted publication rights to the images while other rights are reserved by futureimagebank.com.

A subscription gives you unlimited downloads for all futureimagebank.com content against one payment only! Naturally you need to follow and respect our license agreement in using the content.

Publication rights

Images with individual usage history

You can see detailed information of the previous downloads for images with our individual usage history. This way you can make sure the image suits with the usage you plan to have. Majority of futureimagebank.com images comes with individual usage history. Only exceptions are Royalty Free images.

The image bank images of people and products without a recognizable product label or brand are free for use in advertising. The images can also be used in brochures, catalogues, product packaging, books and posters, magazines and newspapers, on the Internet, multimedia, on TV and in videos. The size of images published on the Internet must not exceed 480 x 240 pixels, and their resolution must not exceed 72 dpi. If the pictures are used as a part of a layout, so that only the pictures can not be separated from the entirety, the maximum size is 800 x 600 pixels, 72 dpi. Publication of images showing items that are subject to copyright or trade mark or brand rights takes place at the end-user's responsibility.

To clarify, the images may NOT be used for resale, license or other distribution not mentioned above. This means, without limitation, all templates, whether online or not (website templates, Flash templates, business card templates etc.), in any posters, postcards or other items for resale, license or distribution for profit. More information about the rights and rights restrictions can be found on the "FAQ" page or from our customer service.

The placing of images or their size in the publications is not restricted (with the exception of the Internet), i.e. the images can be freely used on front pages, inside pages or back covers in the desired size.

The images must not be used in a context that would infringe the professional or commercial interest or artistic value of the photographer or persons, trademarks or brands illustrated in the images. You may not under any circumstances use images in connection with any pornographic, obscene, immoral, or illegal materials. Individual persons may not be cropped off for publishing on their own from images showing more than three persons. The images may be assembled into so-called collages provided that the above restrictions are observed.

When publishing the images, the source must be mentioned as "futureimagebank.com / name of photographer". The granted publication rights do not constitute exclusive rights, save in the case of so-called Frozen image terms and conditions. The source must always be mentioned in conjunction with all editorial use. For commercial usage, it is recommended that the source be mentioned.

The end-user is not entitled to transfer his/her rights under this contract to a third party.

The end-user has the right to publish the image once the image file has been downloaded from the image bank and the image usage report has been filled in correctly. The first publication must be done in two months time from image download. The publication / campaign may consist of separate elements (advertisements, brochures, Internet pages, etc.) but it must clearly be one single campaign involving the same subject/customer.

There are no time limits for the usage of images downloaded from futureimagebank.com. Reprints etc. are allowed from the original layout document or printing films or equivalent.

If the end-user wants to use the same image for a different campaign/customer, he/she must download the image again and fill in a new image usage report.

A frozen image is disabled from futureimagebank.com in user´s country for a period of six months from the date of downloading. While the freezing is active the image can not be seen and downloaded from the futureimagebank.com by others in same country, so new publications for the frozen images are not allowed.

The publication rights apply to publishing the image only in the country mentioned in users "My details" page.

Royalty Free images

All terms are valid for Royalty Free images as they stand, except the time limits for the usage: you are allowed to use a Royalty Free picture as long and as many times as you want. This is also the reason why we can not show a reliable usage history for Royalty Free images. All Royalty Free images are clearly marked with "RF" symbol.

Invoicing and pricing

futureimagebank.com will invoice the end-user as per the price list valid at the time. The end-user's rights under this contract are subject to the invoices being paid by the due dates.

End-user's liabilities

The end-user will be responsible for checking the quality of the image and liable for the full amount of any damages caused by non-contractual use of images to futureimagebank.com and the third parties whose rights have been infringed by the non-contractual use.

The end-user having futureimagebank.com subscription is obliged to keep updating end-users own image downloads in such a way that the downloads for images that have been downloaded by mistake, or have not been published, are deleted from the end-users download history. The update must be carried out within 30 days of each image download. The download history entries are managed under "Images that I have previously downloaded from the image bank" in the "My details" menu.

futureimagebank.com liability and limitation of risk

futureimagebank.com ensures that it is entitled to offer the image publication rights subscribed in this contract for the images downloaded from the image bank.

futureimagebank.com does not guarantee that the service will be up and running without interruptions and is not liable for damages caused by errors, interruptions, delays, break-downs, viruses, or other damaging elements, or negligence in data transfer, computers or software. If, however, the aforementioned interruption is caused by futureimagebank.com and it lasts for more than twenty-four (24) hours non-stop, futureimagebank.com will automatically extend the user's agreement period by the portion that exceeds twenty-four (24) hours. futureimagebank.com is also not liable for damages caused by force majeure or corresponding events within the limitations of the service.

futureimagebank.com will not be responsible for any such direct or indirect damages suffered by end-users or third parties that are caused by the use of images contrary to the terms of this contract or the technical instructions.

In all liability cases, futureimagebank.com limits the liability for damages to no more than the price that the user has paid for the service.

futureimagebank.com reserves the right to immediately terminate an end user's agreement if the end user breaches the conditions laid out in this contract.

Other conditions

These terms and conditions apply to registered end-users. All rights under this contract will expire immediately when the registration expires.

futureimagebank.com may freely:

  • Track your image downloads
  • Put your account under special monitoring if your daily downloads exceeds 10 images
  • Monitor possible misuse of your user id and password
  • Terminate your account without a separate notice if we have serious suspects about image misuse or you user id and password or misuses against this contract

Image download histories are collected and presented according to the user inputs in the download process. We take the reporting very seriously but we cannot guarantee the accuracy or the correctness of the image download histories.

futureimagebank.com cannot guarantee that anybody else is not using a "frozen" image during the freezing period. All users that downloaded the image before the freezing date are allowed to use the image in the reported original use. However no new downloads will occur since the image is disabled in users country from the moment of the image freezing.

futureimagebank.com reserves the right to remove any images from the image bank. In such cases the image may still be used in the original use, but no new usages are allowed.

The end-user is entitled to give notice to terminate its registration with immediate effect. However, the subscription fees already paid will not be refunded. futureimagebank.com reserves the right to immediately terminate an end-user's agreement if the end-user breaches the conditions laid out in this contract.

Any disputes arising from this contract will fall within the jurisdiction of the Helsinki District Court, Finland.
